§ 1 GENERAL
All deliveries and services of www.paulinamaternity.com shall be performed exclusively on the basis of the following General Standard Terms and Conditions set forth below, in the currently valid version. We do not recognize any provisions of the customer which conflict with or deviate from these General Standard Terms and Conditions, unless Paulina e. K. has expressly agreed to their validity in writing.
§ 2 IMPORTANT NOTES
1. Every effort has been made to render colors accurately. However, due to the constraints of digital reproduction on various web-browsing platforms, we cannot guarantee true color representations.
2. Please be aware that at the time of your visit to the website items may have been sold out or there could be a re-adjustment in the price. All prices shown on the site are listed in EURO inclusive of VAT. Shipping costs however, will be charged extra.
3. Paulina e. K. is eligible for partial shipping.
§ 3 CONCLUSION OF CONTRACT
1. The contract between the customer and Paulina e. K. begins once items have been placed in the shopping bag and the completed order forms sent by clicking the corresponding button (binding order) and through the acceptance of our offer which will be sent in the form of a confirmation via e-mail to the e-mail address provided to us by the customer and or through the delivery of the product. When placing the order, the customer accepts the legal Terms and Conditions of www.paulinamaternity.com.
2. If in any case the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, we will notify you by e-mail and refund the Advance Payment to your credit card.
3. We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment. Furthermore, we may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.
§ 4 SHIPPING RATES & POLICIES
1. German VAT will automatically be deducted from merchandise shipped to non-EU countries. This will be clearly indicated during the order process. Please note that custom taxes and duties for each individual country may be applied through the shipping company DHL and will be invoiced separately through them. We endeavor to dispatch all orders within 24 hours, however, please allow up to seven days for delivery as external factors may cause delays.
2. Shipping costs will be calculated only depending on the destination of your package. All deliveries will be made with our logistics partners DHL.
3. Paulina e. K. insures each purchase during the time it is in transit until it is delivered to you. You will be asked to sign for any goods delivered at which point responsibility for your purchased goods passes to you.
4. All deliveries will be made to the address given by the customer unless otherwise requested. Estimated delivery times are not binding unless exceptions regarding delivery have been agreed upon.
§ 5 PAYMENT
For our international customers we only accept prepayment or credit card payment for the time being. We accept Master Card and Visa. All credit card information (numbers, expiry dates etc.) will be handled with a coded system that ensures that third parties will not have un-allowed access to the card. After transaction, the card information will only be used again in the case of, for example, refunds. www.paulinamaternity.com works with the security software SSL (Secure Socket Layer.) This is an asymmetrical system that prohibits the manipulation and copying of credit card information placed in the system during a purchase. The final price for overseas customers will be calculated in accordance with the applicable exchange rate on the day your credit card company processes the transaction.
§ 6 DELAY OF PAYMENT
1. Payment will be debited and cleared from your account when the order is dispatched by www.paulinamaternity.com. You confirm that the credit/ debit card that is being used, is yours. All credit card holders are subject to validation checks and authorization by the card issuer.
2. If the issuer of your payment card refuses to authorize payment to Paulina e. K., we will not be liable for any delay or non-delivery.
3. For prepayment please make sure that we receive full payment excluding international fees for bank transfer.

§ 7 RESERVATION OF OWNERSHIP
All products remain the ownership of Paulina e. K. until full payment is made.
§ 8 RESTRICTIONS ON LIABILITY

2. The laws regarding damaged products and liability apply.
3. Paulina e. K. is not liable for any damages that did not occur in direct connection with delivery. Paulina e. K. is not responsible for any monetary loss or financial hardships of the customer. Paulina´s established liability limitations extend to its workers, representatives and supporters. Preceding liability restrictions are invalid as long as damages are not intentional or the result of negligence or involves personal injury.
§ 9 RETURNS AND EXCHANGES
1. Returns and exchanges requested within 14 days of delivery.
International customers are required to return unwanted orders at their own cost to: Paulina Maternity e. K., Lochhamer Schlag 10b, D-82166 Graefelfing, Germany.
3. When all requirements of under these Terms and Conditions have been met, we will notify you and refund the entire cost of the returned product(s). Should you fail to meet any of these requirements, you will be notified and may have the possibility to have the merchandise returned to you. We are, however, not responsible for any additional shipping costs. Should you refuse to accept the returned merchandise, we reserve the right to keep the item and the corresponding amount that was paid.
5. Paulina e. K. will only accept returns for items that have not been worn, altered or washed. We strongly advise all customers to check garments thoroughly upon delivery before removing any attached tags and before disposing of any original packaging.
6. Please note that a time frame of anywhere between 10-14 days can pass between the receipt of your returned merchandise and the return/ refund process. The refund time frame depends on the credit card used. Normally credit appears within two months. In case the recipient of the product does not correspond with buyer of the product, a credit will be refunded to the original buyer and the credit card holder. Pre-paid order refunds usually take place within 10-14 days. Please note that shipping costs will not be refunded.
7. Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Union (EU).
§ 10 DATE SECURITY
1. Our data protection procedures are in conformity with the Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG) and the Telemedia Data Protection Act (Telemediengesetz – TMG).
2. The customer hereby agrees that Paulina e. K. may process, store and evaluate the customer data, received in connection with the business relationship.
3. The customer shall be informed about and be given the opportunity to correct, block and delete his/ her personal data. If judicial or contractual keeping obligations exist or any other judicial reasons oppose to a deletion, the data will be blocked.
4. To ensure that no personal data can be seen by third parties during data transfer, we use a modern encryption technology. At the moment, we use Secure-Socket-Layer encryption (SSL), as proposed by international data protection agencies.
§ 11 APPLICATION RIGHTS
1. The customer's rights hereunder shall not be transferable.
2. Should one or more of the provisions in these General Standard Terms and Conditions become invalid, this shall not affect the validity of the General Standard Terms and Conditions as a whole. The invalid provision shall be replaced with a relevant statutory provision.
3. The validity of the UN Convention on contracts for the International Sale of Goods (CISG) shall be excluded. German law shall prevail.
